Terms of Use / End User License Agreement

1. Acceptance
By creating an account, accessing, or using Workday Wits, you agree to these Terms.
2. Eligibility
You represent that you are legally able to enter into these Terms and will comply with applicable laws.
3. Account Registration
You are responsible for:
- providing accurate account information;
- maintaining the confidentiality of your credentials;
- all activity occurring under your account.
You may register using credentials we provide directly or through supported third-party identity providers.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the service for its intended purpose.
5. Acceptable Use
You agree not to:
- misuse the service;
- attempt unauthorized access;
- interfere with service operation;
- submit unlawful, infringing, harassing, or abusive content;
- submit hateful, threatening, sexually exploitative, self-harm-promoting, doxxing, or otherwise unsafe content;
- use the service for fraud or deceptive conduct.
6. User Content
You retain ownership of content you submit, to the extent permitted by law. You grant us a license to host, store, reproduce, display, and process that content as needed to operate and improve the service.
We may use automated and human review systems to detect, block, review, remove, or restrict content that violates these Terms, threatens users, creates abuse risk, or jeopardizes the integrity of the service or third-party providers we rely on.
We may preserve limited moderation, security, and audit records associated with submitted content where permitted by law and reasonably necessary for abuse prevention, dispute handling, legal compliance, or system integrity.
Access to content-management capabilities may be restricted to designated administrative roles, and we may revoke those privileges at any time to protect the service or its users.
7. Groups, Gameplay, and Collaboration
We may provide features involving Groups, rooms, messages, scores, submissions, and historical gameplay data. You acknowledge that some activity associated with your account may remain visible to other authorized users while your account is active, and may remain in anonymized or retained records after closure where permitted by law.
8. Account Suspension, Closure, and Deletion
You may request closure or deletion of your account through the service, subject to identity verification and applicable law.
When an account deletion or closure request is processed:
- your access to the service may be terminated;
- authentication credentials may be disabled or removed;
- personal information will be deleted, anonymized, or retained according to our Privacy Policy and applicable law;
- some records may remain where retention is required for legal, security, fraud-prevention, accounting, dispute, moderation, or system-integrity reasons.
We may suspend or terminate accounts that violate these Terms or create security, legal, or operational risk.
9. Data Retention After Closure
After account closure, we may retain limited records for a defined period, including:
- security and access logs;
- records needed for legal compliance;
- records needed to investigate abuse or disputes;
- gameplay, scoring, and collaboration records in minimized or anonymized form;
- ownership and audit records necessary to preserve system integrity.
Retention periods are described in the Privacy Policy.
10. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
11. Third-Party Services
The service may rely on third-party services, including identity, hosting, analytics, and communications providers. Your use of those services may also be subject to their terms and policies.
12. Intellectual Property
The service, software, branding, and content provided by us are protected by intellectual property laws. Except for the limited license granted in these Terms, we reserve all rights.
13. Disclaimers
The service is provided "as is" and "as available," to the fullest extent permitted by law. We disclaim warranties except as required by law.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill arising from use of the service.
15. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the service, violation of these Terms, or infringement of rights.
16. Governing Law
These Terms are governed by the laws of the United States of America, without regard to conflict-of-law principles, except where mandatory local law provides otherwise.
17. Changes to the Terms
We may update these Terms from time to time. Continued use of the service after changes become effective constitutes acceptance of the updated Terms.
